Terms of Service

These Terms are an agreement between you and Make Me ("we," "us"). They apply when you visit makemegummies.com, place an order, subscribe, or use the Make Me app or playlists.

Section 15 contains a binding arbitration agreement and a class action waiver. Please read it.

1. Adults only

You must be at least 18 years old, or the age of majority where you live if that is higher, to use our site or buy from us. By ordering, you confirm that you are. We may ask for age verification and cancel any order we believe was placed by someone under 18.

2. What Make Me is

A Make Me box contains edible gummies, a deck of cards and access to digital content such as the Make Me app and playlists, along with a date-night plan.

Everything in the box is designed for two consenting adults. Every card is an invitation, never an obligation: either of you can skip any card at any moment.

3. Product use and safety

• Read the ingredient list and directions on the label before eating the gummies. Don't use them if you're allergic to any ingredient.
• Talk to your doctor before use if you're pregnant or nursing, take prescription medication, or have a medical condition.
• Keep out of reach of children.
• Make Me is not a medicine and is not intended to diagnose, treat, cure or prevent any disease or condition. Experiences vary from person to person.

4. Subscriptions

What you agree to. When you choose a subscription, you authorize us to charge your payment method at checkout and then automatically every 4 weeks at the subscription price shown at checkout, plus any shipping and taxes, until you cancel. Each charge covers one box.

Skip, pause or cancel anytime. You can skip a box, pause, or cancel online in your account at makemegummies.com/account, with no phone call or email needed. Changes made before your next renewal charge apply to that renewal. Changes made after it apply from the following one. You can also cancel by emailing mmr@makemegummies.com.

Reminders. We'll email you before each renewal 3 days in advance, and at least once a year with your subscription's price, frequency and how to cancel.

Price changes. We'll email you at least 14 days before any price increase applies to your subscription. You can cancel before it takes effect.

Failed payments. If a renewal payment fails, we may retry it over the next 7 days. If it still fails, we'll pause your subscription and let you know.

Refunds. Renewal refunds follow our Refund Policy, including the 7-day window for renewals charged before you cancelled.

One-off boxes. You can also buy a single box without a subscription. It will not renew.

5. Orders, prices and payment

All orders are subject to acceptance and availability. We may limit quantities or refuse or cancel an order, including for suspected fraud, resale, an apparent pricing error or an underage purchaser. If we cancel after charging you, we'll refund you in full.

Prices are in US dollars unless shown otherwise at checkout. Charges appear on your statement under a neutral name that doesn't mention the product.

6. Date-night plans and third parties

Your box may include suggestions for places to go and things to book. These are recommendations. Bookings and purchases you make with restaurants, venues and other third parties are between you and them, under their terms, prices and cancellation rules. We're not responsible for their services, availability or conduct.

7. App and digital content

We grant you a personal, non-transferable, revocable license to use the Make Me app, cards and playlists for your own non-commercial use while you are a customer. Playlists hosted on third-party services such as Spotify are subject to those services' terms. You may not copy, resell or redistribute our cards or content.

8. Shipping, risk of loss and returns

Shipping is covered in our Shipping Policy and returns in our Refund Policy. Title and risk of loss pass to you when we hand your order to the carrier, but we'll still replace boxes that are lost or arrive damaged as described in those policies.

9. Marketing messages

If you sign up for marketing emails, you can unsubscribe at any time using the link in any email.

10. Reviews and content you send us

If you post a review or send us content, you give us a non-exclusive, royalty-free license to use, display and share it in connection with Make Me. Don't post anything unlawful, explicit or that identifies another person without their consent. We may remove content at our discretion.

11. Intellectual property

The Make Me name, logo, cards, app, designs, photos and text are owned by Make Me or its licensors and protected by intellectual property laws. Don't use them without our written permission.

12. Prohibited use

Don't use our site to break the law, resell our products without authorization, interfere with the site's security or operation, scrape it, or impersonate anyone.

13. Disclaimers and limitation of liability

To the fullest extent permitted by law, the site and products are provided "as is" and "as available," without warranties of any kind beyond those required by law.

To the fullest extent permitted by law, Make Me is not liable for indirect, incidental, special, consequential or punitive damages. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Some jurisdictions don't allow these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

You agree to cover our reasonable costs from claims caused by your breach of these Terms or misuse of our products or site.

15. Disputes: arbitration and class action waiver

Talk to us first. Before filing any claim, email mmr@makemegummies.com with a description of the issue. We'll try to resolve it within 30 days.

Arbitration. If we can't resolve it, any dispute will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either of us may bring a qualifying claim in small claims court instead.

Class action waiver. Claims may be brought only individually, not as a plaintiff or class member in any class or representative proceeding.

Opt out. You can opt out of this arbitration agreement by emailing mmr@makemegummies.com within 30 days of your first purchase with the subject "Arbitration opt-out."

16. Governing law

These Terms are governed by United States federal law and the laws of the state where you live, without regard to conflict of law rules.

17. Changes and general terms

We may update these Terms by posting a new version here. Changes don't apply to orders placed before the update. Material changes to subscription terms are emailed to subscribers in advance.

If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Refund, Shipping and Privacy Policies, are the entire agreement between you and us.
